Tutti Linens, LLC – Terms & Conditions

Effective Date: August, 26th, 2025

These Terms & Conditions (“Agreement”) govern all rental transactions between Tutti Linens, LLC (“Company”) and the customer (“Client”). By placing an order with Tutti Linens, LLC, the Client acknowledges and agrees to be bound by these Terms & Conditions.

1. Rental Period: The standard rental period is three (3) days. All rentals must be returned on the first business day following the event. Extended rental periods may be available by prior written agreement. Late returns will incur a fee of twenty-five percent (25%) of the total order value per day. After five (5) days, items will be deemed lost and full replacement costs will apply.

2. Reservations and Payments: A fifty percent (50%) non-refundable deposit is required to reserve rental items and event dates. The remaining balance is due thirty (30) days prior to the event date. Orders placed within thirty (30) days of the event must be paid in full at booking and are non-refundable. Availability is not guaranteed until the deposit has been received.

3. Delivery, Pickup, and Shipping: Tutti Linens, LLC offers delivery and pickup within Raleigh, NC and Greensboro, NC for an additional fee. The Client is responsible for ensuring that an authorized representative is present at the designated delivery/pickup location. For shipped rentals, the Client is responsible for all shipping costs both ways and must use the original packaging provided. Late return shipping will incur a daily charge of twenty-five percent (25%) of the total order value. Tutti Linens, LLC is not responsible for delays, errors, or failures caused by third-party shipping carriers, weather conditions, or other events beyond its control.

4. Care of Rentals: The Client shall not launder, clean, or otherwise treat rental linens. Linens must be brushed free of debris and returned dry in the original packaging provided. Any attempt to launder or improperly treat linens may result in additional damage charges.

5. Damage Beyond Repair and Replacement Fees: Damage that cannot be remedied through standard professional laundering shall be deemed “damage beyond repair.” Such damage includes, but is not limited to: candle wax, permanent stains, mildew or mold, cuts, tears, holes, or burns, and alterations including stapling, gluing, cutting, writing, or other permanent modifications. In the event of damage beyond repair, the Client shall be invoiced for a replacement fee equal to four (4) times the rental price of the item. The Client will also be invoiced for the full replacement cost, equal to four (4) times the rental price, for any missing items. Normal wear such as minor stains or light soiling is expected and covered in the rental fee.

6. Inspection Period: The Client must inspect all rental items immediately upon delivery or receipt and notify Tutti Linens, LLC of any defects, shortages, or issues within twenty-four (24) hours. Failure to notify Tutti Linens, LLC within this time frame shall constitute acceptance that all items were received in good condition.

7. Cancellations: Cancellations made more than thirty (30) days before the event will forfeit the deposit, which is non-refundable. Cancellations made less than thirty (30) days before the event will require payment of the full rental fee. Custom orders are non-refundable once confirmed.

8. Order Changes and Custom Orders: Changes to orders may be made until 5:00 p.m. EST on the Final Confirmation Date. Reductions in quantity after this date will not be permitted. Additions made after the Final Confirmation Date may require expedited shipping and will be billed separately. Custom orders require final counts and full payment at the time of booking. Tutti Linens, LLC cannot guarantee the availability of custom fabrics beyond the date of quotation.

9. Liability: The Client assumes full responsibility for rental items from the time of delivery until items are returned to Tutti Linens, LLC or its authorized carrier. The Client shall not return rental property to any entity or person other than employees of Tutti Linens, LLC or a freight carrier authorized by Tutti Linens, LLC. Reasonable identification must be obtained prior to surrendering possession. Tutti Linens, LLC shall not be held liable for injury, damage, or loss caused by the use of rental items.

10. Security of Property: The Client is responsible for ensuring that all rental items are properly secured and protected from theft, weather exposure, or damage at all times during the rental period. Failure to secure rental property may result in replacement or damage charges as outlined in Section 5.

11. Force Majeure: Tutti Linens, LLC shall not be liable for failure or delay in performance due to circumstances beyond its control, including but not limited to weather, natural disasters, shipping carrier delays or errors, strikes, accidents, or supply chain disruptions.

12. Collection of Costs: In the event of non-payment, the Client shall be responsible for all reasonable costs of collection incurred by Tutti Linens, LLC, including attorney’s fees, court costs, and collection agency fees, in addition to any outstanding balances owed.

13. Photography and Promotion Release: The Client grants Tutti Linens, LLC the right to use the Client’s name, likeness, event details, and photographs of events featuring Tutti Linens, LLC products for marketing and promotional purposes, in any medium, without further compensation. The Client waives any right to review or approve such materials.

14. Governing Law and Jurisdiction: This Agreement shall be governed by and construed under the laws of the State of North Carolina. Any disputes shall be resolved exclusively in the courts of Wake County, North Carolina.

15. Entire Agreement: This Agreement constitutes the entire understanding between the Client and Tutti Linens, LLC. No oral statements or prior agreements shall have any effect.

16. Agreement and Authorization: By booking with Tutti Linens, LLC, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions. The Client further acknowledges that failure to pay any invoiced rental fees, damages, replacement fees, or late return charges may result in legal action to recover the amounts owed.
